Background to This Action
The 2nd Plaintiff by a Lease Agreement dated the 19th December 2012 and registered as No.293/2012 at page 32 of volume 109 of the record books of leases kept in the office of the Administrator and Registrar General, Roxy Building Walpole Street Freetown, is said to be seised of a leasehold interest in property situate at Pipeline Spur Loop Wilberforce Freetown, holding same from the 1st Plaintiff's deceased husband, Desmond Edgar Fashole-Luke(hereafter called "the Intestate’). ‘Sometime in early 2019, the 2nd Plaintiff reported to the intestate that, certain persons had forcibly entered the land and commenced thereon, activities that are inconsistent with his title to the said property. After all efforts to ward these individuals off this property proved futile, the intestate initiated an action against two of the alleged intermeddlers and others unknown, in the High Court, by writ of summons dated the 7th March 2019. On the 12th March 2029, the Intestate as Plaintiff in that action, applied for and obtained an interim injunction, restraining the Defendants in that action, their Agents, servants, privies, proxies or howsoever called, from entering and/or remaining upon the said land, The said Order is exhibited ase" The injunction was accordingly served on the Defendants in the said action, by Counsel representing the Intestate then M.P. Fofanah esq, This notwithstanding, the Defendants continued to interfere with the land in dispute. On the 23rd May 2019, the Intestate applied for and obtained default judgement against the Defendants and which Judgement was served on the said Defendants. Again the Defendants allegedly refused to comply with the Orders of the lower Court. Learned Counsel by letters dated on diverse dates, made several representation to various Authorities, including the Speaker of Parliament, the Chief of Defence Staff, the Chairman Parliamentary Oversight Committee on lands, etc, complaining the conduct of the defendants in the Court below and other unidentified persons and protesting the deployment of armed men clad in military fatigue on the land. The Chief of Defence Staff in one of his letters, denied knowledge of any such deployment. The Chairman of the Parliamentary Oversight Committee on lands, replied by asserting inter alia that, his Committee's investigation revealed that, the land in issue is State land. It was the failure of all of these endeavours by the erstwhile Counsel, that informed the commencement of this action by Counsel now on record AS. Marah esq.
